“Indemnity and Insurance:
Getting the Most Out of Your Contract Indemnity Provisions and Filling Gaps in Potential Exposures”
for DELVACCA’s CLE Institute
Philadelphia, PA (February 10, 2012) – Neil S. Witkes and Nicole R. Moshang, partners with the environmental, energy, and land use law and litigation firm of Manko, Gold, Katcher & Fox, LLP (MGKF), participated on a panel on “Indemnity and Insurance: Getting the Most Out of Your Contractual Indemnity Provisions and Filling Gaps in Potential Exposures”. Their presentation is part of the Delaware Valley Chapter of the Association of Corporate Counsel’s (DELVACCA’s) Contracts and Commercial Law CLE Institute held February 9, 2012 at the Union League of Philadelphia.
The program covered typical and tangential indemnity provisions, drafting tips from a litigator’s point of view, case law examples, as well as the role insurance plays in addressing the allocation of the contractual risk. Program speakers joining Witkes and Moshang included A. Peter Prinsen and Sean H. Brogan of The Graham Company as well as Irene Burak of Philadelphia Industrial Development Corporation.
Witkes has a wide range of civil and administrative environmental and commercial litigation experience, including class actions, toxic tort claims, insurance coverage suits, defense of agency enforcement actions, citizen suits, challenges to agency action, contract claims, and cost recovery actions. He has represented industrial and commercial entities, as well as real estate developers and closely-held companies, in a variety of environmental and general-commercial litigation matters.
Moshang concentrates her practice in environmental litigation, representing clients in state and federal courts as well as administrative forums. These matters involve cost recovery and contribution litigation under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”) and other federal and state environmental laws, citizen suit claims, natural resource damage claims, tort and contract claims, challenges to agency action, class actions, environmental insurance coverage disputes, enforcement and penalty actions. In addition to litigation, she has advised clients on a range of environmental matters, including regulatory compliance with federal, state and local regimes.
